Getting a criminal rape conviction is incredibly hard, especially if you dont report it like right after it happened.
A civil case you are much more likely to win even if some time has passed.

high standard of proof, criminal cases need to reach "beyond reasonable doubt", the state didn't feel like there was enough evidence to prosecute.

The whole 2nd guy story went like this.

1. She accused CMG of rape
2. CMG said they had consenual sex.
3. CMG's mate said he also had consenual sex with her.
4. She had no memory of this '2nd guy' and so stated 'well he must have raped me as well if I can't remember it.'

The theory is that this 2nd guy made it up to try and cover for CMG. No DNA evidence was found for the 2nd guy. It's not so much that she lied about a 2nd guy assaulting her, but that he lied about having sex with her at all.

Obviously the whole thing is dumb.
