It's an advertised feature of Game Pass. Don't they have a commitment to hold to that, especially for people who've already signed up for 2-3 years worth of the service? Seems like a big consumer rights issue (at least in the UK, because lol @ the idea of consumer rights in the US).
I imagine they probably have small print that says no title is a guaranteed day one release, or something like that. They could fulfill the promise with a few throwaway indie games.

I think it will change with Indiana Jones actually. I expect it will be on GP Day 1, but I wouldn't be surprised if it's also on PS5 that day, too.The Indy trailer 2 weeks ago ended with the day 1 on game pass tag, so I think it's a safe bet that the game-pass day 1 thing isn't going anywhere for the foreseeable future.
They might change that for the next generation, with a fresh start, but I don't think it's happening for the current gen.
