If Sony owns it, they may ask some random 3rd party to make a remastered port because Insomniac may be too busy with Spiderman and Ratchet. But I'm not sure if there would be market for it.

Yes, Sony owns it.

That was the entire reason Insomniac made a game for Xbox. They had made all these huge franchises that were now owned by other publishers (mostly Sony) - Spyro the Dragon, Resistance Fall of Man, Ratchet and Clank and Amazing Spider-Man.

They wanted their own IP, but Sony wasn't doing that. Microsoft was willing to in order to get an Insomniac exclusive game on the Xbox.

Of course, Sunset Overdrive didn't sell well on the Xbox One, which led to Insomniac going back to Sony and becoming part of Sony's WWS - Sunset Overdrive IP included.

If the X1 BC is gonna be like the 360/OG Xbox BC they can't do shit without the publishers permission (Sony), its literally a download of an updated version of the game. Now if its an emulator that can play the game natively then Sony can't do shit.

They probably do, but that is very easy to bypass.
All Sony has to do is add some more content to the game (even cosmetic changes will do, like character costumes) and add something extra to the title (director's cut, remix, etc) to be able to release the game on ps4.
As long as MS has the publishing rights and making it BC doesn't require any changes to the game data or re-licensing (music, etc), MS can make it BC on XSX.

MS has publishing rights ON Xbox One. Sony owns the IP and could release the game on PS4/PS5 whenever they want.

Sony couldn't force MS to take down the Xbox version or anything, but other than that, they can pretty much do whatever they want.

I don't think there is no reason for Sony to not release the game on PS5. They own the IP now, and they could do a remaster/reamke, and if sells well on PS, they could continue the franchise.

I have a feeling that Microsoft will allow the game to come to PS5 or something (the rights around the game are complicated though, Insomniac/Sony own the IP, but MS owns the publishing rights and has an exclusivity contract on the game to my knowledge, so there would likely need to be some agreement in place).

I could maybe see MS allowing it if Insomniac does an XSX/X1 patch for the game but honestly I have no idea

I respect Microsoft for taking the chance with it and understand if it can't happen, but it'd be a nice fit to have everything Insomniac (except for the four VR games) be on a PlayStation platform. Well the reasons are the game didn't sell well and Insomniac has several games that DO sell well.

Insomniac has likely built up a good deal more mindshare after their excellent Ratchet & Clank and Spidey.

Releasing a PS5 enhanced version of this game would be a cost effective way to add an additional title to the portfolio. Especially effective during a time where early adopters are scrambling for content to show off the new system.

With 110 Million chances at a sale, I’m not surprised we don’t see more “exclusives” coming to PS4. If it makes dollars it makes sense.

I tried this for about 5 minutes once and it reminded me of Jet Grind Radio but I didn’t have enough hands on to judge it-if it’s just a port and nothing new is added hopefully they make it $40
