Seems a bit rich for MS to be complaining about FRAND licencing when they demand licencing fees from Android to cover patents you're not allowed to know about unless you sign an NDA.

Microsofts android patent fights really have nothing to do with this, and they have nothing in common. Those patents weren't included in a standard under FRAND terms.

hopefully the judge awards a reasonable amount, but the patent system definitely encourages innovation,

what's the point of investing in and developing a new technology if you can't then apply for a patent on it? as they say money makes the world go around, and if they have a legitimate claim to the patent they should get their fair due.

This really isn't about whether Patents are good or bad. In this case, the only reason anyone is infringing on the patents is because Motorola had them included in standards (h264 and wireless) and the only reason those groups (itu and ieee) agreed to include the technology in the standards is because Motorola promised to license the patents on reasonable and non-discriminatory terms.

Well, no, of course they're not FRAND. They're being asserted in an unfair and an unreasonable discriminatory way.

Which is why it's a bit rich for MS to be upset about someone using actual valid patents against them.

Microsoft never agreed to license their patents under frand terms; Motorola did. The situations have nothing in common. Discussing Microsoft's other patent battles only suggests that Motorola is being discriminatory, in addition to being unreasonable.

was only baby threadshitting anyway - these patent threads do tend to devolve into the same discussions pretty quickly - wasn't there talk of just having stuff in one patent thread?

The ruling gives Motorola Mobility leverage in its patent fights with Microsoft that may force settlement talks to avoid an Xbox import ban. Motorola Mobility filed in retaliation for Microsoft lodging patent-infringement claims against Motorola Mobility phones that run on Google Inc. (GOOG)’s Android operating system, the most popular platform for mobile devices.

“Microsoft continues to infringe Motorola Mobility’s patent portfolio, and we remain confident in our position,” said Becki Leonard, a spokeswoman for Motorola Mobility, in an e-mailed statement. “This case was filed in response to Microsoft’s litigate-first patent attack strategy, and we look forward to the full commission’s ruling in August.”
 
Of course MS will settle, they will not risk having 360 banned over this. Looks like Google will make more money off 360 than MS? And MS makes more money off Android than WP7? God I love these stupid battles.
