Pretty much. Fair use is ill defined, but in a lot of cases it would be argued that work of this nature especially would fall under parody and/or transformative use.
On a side note, the DMCA notification has also reportedly been used by Nintendo to flag strikes against adult hosting tumblr blogs that have posted non-pornographic images too.
This made me let out a hearty LOL.

It looks like lots of people are missing the fact that these DMCA takedown notices are more then likely coming from a fake Nintendo employee. It sucks that tumblr does not bother to fact check the take down notices they get.

They've allowed the fans to do as they please with basically any kind of fan-game project. They have been pretty amazing to the fans in that regard. So if they don't want their characters being portrayed in a pornographic way, they should be able to take a stance on it and say they don't like it.

its funny cause everything you said is wrong.
They cracked down hard on romhacks and Zelda Maker all because of Mario Makers release. Not to mention A Fox In Space running into some trouble too and various other fan projects. Porn is not something they can go after.

Due note, I didn't say very project ever, I said basically. Let's not be too literal here. None of the projects I've followed, like various Metroid projects have run into had issues. Lunar Magic, is still up and available for download? Zelda classic is still around...
Its even worse when you put it that way. "They allow some fan projects here and there off the hook so its ok if they take down porn".

What "bunch?" Only rom hacks they've targeted recently were some Kaizo Mario ones on Niconico, and the only recent fan projects were ones that attempted to fully reproduce their games for free.
Only vaguely remember hearing about TAS stuff.
People have such a weird-ass vendetta against Tumblr, it's gotten sad.

Sorry to shamelessly bump my own thread on this matter, but apparently Nintendo have once again hit tumblr accounts/artists with a DMCA wave.
Unfortunately no where I can particularly link to as source on Gaf without a ban accompanying it, but the latest wave of content flags was brought against Zelda artists.

Tumblr has been hit with these all year, but the veracity of nintendo actually pulling them is spotty at best, tumblr pussies out of legal matters so, anybody can claim to be nintendo and send an email to the staff and your artwork will get taken down.
The biggest tell is, Pokemon stuff (ie anthropomorphic pokemon furry artwork) has been the prime target, however all the supposed takedowns are flagged as "from nintendo" which doesn't make any sense, since The pokemon Company handles that IP, which means the claim comes from a fake source but tumblr chooses to not take risk and just take down the offending content.
It's an easy to abuse system.
